This was the first meeting of the newly formed construction committee. Roland Ochsenbein acting chair until committee organizes. John Rodenhiser recorded minutes.

·       Members introduced themselves.

·       A briefing book was handed out and reviewed. The book was intended to give each committee member an overview of where the project stands at the point that the LCC is picking it up. It contained: Project Description and Overview, the Building Program document, WI standard worksheets, the town-wide survey and vision committee report, the full Richmond French Design Program Study, the full set of cost estimates and budget summaries, color copies of all building and site plans, Recommended Practices For Hiring Owner’s Project Managers, Designing and Constructing Public Facilities, and a copy of 605 CMR.

·       Mickie Simpson led a short discussion of the Construction Manager At Risk program.

CM at Risk is an alternative to the traditional design-bid-build method of building as embodied in Chapter 149. A new statute, M.G.L. c. 149A, was created by Chapter 193 of the Acts of 2004 that provides the option to cities and towns (as well as public agencies) to use the CM at Risk method for building projects valued at $5 million or more. Under CM at Risk, a public owner prequalifies and selects a Construction Manager (CM) during the design phase. The CM provides planning, estimating, scheduling and other consulting services to the Owner and Architect during the design phase. When the design is near completion, the CM and the awarding authority negotiate a Guaranteed Maximum Price ("GMP") and schedule. The CM then acts as the general contractor during the construction of the project and prequalifies and procures all of the construction trade contractors that will perform the work. The CM is required to share all cost information with the public owner so that an informed public owner will only pay for the Cost of the Work plus an agreed fee for the CM up to the GMP.

How this program relates to Chapter 193 “Regulating Public Construction in the Commonwealth” which is currently mandated by the MBLC’s grant program is not well understood. Mickie will investigate inviting several members of a panel discussion she attended to come in and explain further.

·       Brent and Mickie accepted the assignment of reviewing the current draft of the Project Manager RFP and coming back to the committee at next meeting with revised draft for review.

·       Roland proposed inviting in some experienced Project Managers to give advice and counsel.

·       Kelly explained that she has been tasked by the trustees to locate alternate library space during construction. The MBLC requires that the library remain operational during this period. While not an LCC responsibility, Kelly asked all to think of alternate sites and pass suggestions on.

·       Briefly reviewed Open Meeting Law.

·       An observer present introduced himself: He is John Volkert, of Boxboro, an experienced Project Manager who managed construction of three schools in Westford and the recently completed Maynard Library. Trying to stay familiar with the Bolton project as he may want to respond to the PM RFP when posted.
